Terms of service

These terms are an agreement between you and AudienceKit (“we”, “us”). They apply when you use AudienceKit and the community apps built on it, including Hot Mess, on any device or website (“the apps”). By using the apps you agree to these terms and to our privacy policy.

Who can use the apps

You must be at least 18, or older if your local law sets a higher age, and able to make a binding agreement. You sign in with Facebook, so you must also follow Facebook’s terms.

Your account

Keep your Facebook account secure; anything done with your account is your responsibility. Tell us at once at hello@audiencekit.com if you think it has been misused.

Using the apps

Be a good neighbour. Don’t:

  • harass, threaten, out, or share private information about anyone;
  • post anything illegal, hateful, or sexually explicit, or anything you don’t have the right to share;
  • send false safety pings or misuse safety features;
  • pretend to be someone else, or a venue or organizer you don’t represent;
  • scrape, overload, reverse engineer or interfere with the apps, except as the law allows.

We can remove content or suspend accounts that break these rules.

Venues, events and listings

Listings for venues, events, performers and hosts come from public sources and from organizers. We work to keep them accurate but can’t promise that every time, price or detail is right, or that an event will happen. Tickets bought through a link go through the ticket seller, under its terms. Check with the venue or organizer before you travel.

Going out has risks. You’re responsible for your own safety and choices at any venue or event, and the safety ping feature is not a substitute for emergency services. In an emergency, call your local emergency number.

Organizers and audience owners

If you run an audience or manage venue listings, you’re responsible for the content you add and for having the right to publish it. You give us permission to host, display and adapt that content so the apps can show it.

Your content

You keep ownership of anything you post. You give us a worldwide, non-exclusive, royalty-free licence to host, store, display and share it within the apps so we can run them. The licence ends when you delete the content or your account, except for copies others have already shared or that we must keep by law.

Our service

The apps, their design and the AudienceKit name are ours or our licensors’. We may change, add or remove features, and we may stop offering an app, giving notice where we reasonably can.

Disclaimers and liability

The apps are provided “as is”. To the extent the law allows, we disclaim all warranties, and we aren’t liable for indirect or consequential losses, or for anything that happens at a venue or event. Our total liability to you is limited to US$100. Nothing in these terms limits liability that can’t be limited by law.

Ending your use

You can stop using the apps and delete your data at any time. We may suspend or end your access if you break these terms.

Changes

We may update these terms. If a change matters, we’ll update the date at the top and tell you in the app before it takes effect. If you keep using the apps after that, you accept the new terms.

Law

These terms are governed by the laws of the State of Washington, USA, except where your local law gives you rights that can’t be waived.
